1. Acceptance of these terms
By accessing or using the FlashBar website, mobile application, administration tools, or related services (together, the “Service”), you agree to these Terms & Conditions and our Privacy Policy. If you do not agree, do not use the Service.
2. Eligibility and responsible use
You must be legally permitted to use the Service and to enter licensed venues in your location. Features involving alcoholic drinks are intended only for people who meet the applicable legal drinking age.
FlashBar does not sell or serve alcohol. Participating venues are responsible for age checks, responsible service, admission, and compliance with applicable licensing laws. Venue staff may refuse service where legally required or reasonably appropriate.
3. Accounts and security
You must provide accurate information, keep your login details confidential, and promptly notify us of suspected unauthorized access. You are responsible for activity performed through your account unless applicable law says otherwise.
Business owners are responsible for approving employees, selecting appropriate roles, removing access when employment ends, and reviewing permissions regularly.
4. Offers and redemptions
Offers are created and fulfilled by participating venues. Each offer may have its own start time, expiry, availability, redemption limit, location, product, age, or other conditions.
- An offer may expire, sell out, be cancelled, or become unavailable before redemption.
- An offer cannot be exchanged for cash unless the venue states otherwise or the law requires it.
- Codes, QR details, and redemption credentials must not be copied, resold, manipulated, or shared improperly.
- A successful claim does not override lawful venue policies, capacity limits, licensing requirements, or clearly displayed offer conditions.
If an offer description conflicts with mandatory consumer law, that law applies.
5. Business and employee responsibilities
Businesses must have authority to list each venue and must keep venue information, images, opening details, offers, and staff assignments accurate. Businesses must honor valid offers as described, except where refusal is required by law or necessary for safety.
Employee accounts may receive permissions based on a role, including Manager, Barman Plus, or Barman. Owners remain responsible for role configuration, employee actions, and access removal. Employees must only use permissions for authorized work at the assigned bar.
6. Acceptable use
You may not:
- Use the Service for fraud, harassment, unlawful activity, or unsafe behavior.
- Create false accounts, bars, offers, reviews, scans, or redemption records.
- Attempt to bypass access controls, interfere with the Service, scrape it at unreasonable volume, or introduce harmful code.
- Infringe intellectual property, privacy, publicity, or other rights.
- Use another person's account or employee permissions without authorization.
7. Content and intellectual property
You retain ownership of content you submit, such as venue images, descriptions, reviews, and reports. You grant FlashBar a worldwide, non-exclusive, royalty-free licence to host, display, resize, reproduce, and use that content only as needed to operate, secure, improve, and promote the Service.
You confirm that you have the rights and permissions needed to submit the content. FlashBar may remove content that violates these terms, the law, or the rights and safety of others.
The FlashBar name, software, interface, and original materials are owned by FlashBar or its licensors and may not be copied or exploited except as allowed by law or written permission.
8. Third parties and service availability
Venues are independent businesses, not agents of FlashBar. FlashBar is not responsible for venue admission, products, service quality, pricing, safety, or conduct, except to the extent liability cannot legally be excluded.
We aim to keep the Service reliable, but do not guarantee uninterrupted or error-free operation. We may maintain, update, suspend, or change features for security, legal, or operational reasons.
9. Disclaimers and limitation of liability
The Service is provided on an “as available” basis. To the maximum extent permitted by law, FlashBar excludes implied warranties and is not liable for indirect, incidental, special, or consequential loss, loss of profit, or loss caused by a participating venue or another user.
Nothing in these terms excludes liability that cannot legally be excluded, including liability for fraud or for death or personal injury caused by negligence where applicable.
10. Suspension and termination
You may stop using the Service at any time. We may restrict or close an account that violates these terms, creates risk, is used unlawfully, or must be restricted to protect users, venues, or the Service. Where appropriate, we will provide notice or an opportunity to appeal.
11. Changes and applicable rights
We may update these terms as FlashBar changes. Material updates will be communicated through the Service or another reasonable method. The “Last updated” date shows when this version took effect. Mandatory consumer rights and local laws continue to apply.
